Who Can Cause a Wrongful Death

When it comes to a wrongful death suit, almost anyone can be a defendant. Wrongful death is a civil matter involving any death that occurred due to another person's negligence. This is different from murder, which is a criminal charge filed when an action was intended to cause death. Here are just a few of the people who can be responsible for a wrongful death.

Doctors

If a doctor or surgeon fails to act appropriately, makes a mistake, or misses a diagnosis that could reasonably be expected to be found earlier, that doctor can then be sued for wrongful death. The wrongful death suit would be a separate case from any medical malpractice suit that could arise from the same incident.

Governments

Road hazards and problems that are not clearly marked and addressed by the municipality that maintains them can result in fatal accidents and wrongful death suits. The government may also be at fault if a child drowns in a municipal pool or if the police use excessive force on a person who later dies.

Others

A wrongful death suit may be filed anytime one person's negligence causes the death of another, so the list of potential defendants is a long one. Drivers who cause fatal accidents can be sued, as can bartenders or bar owners who served an intoxicated person. Product manufacturers can also be targeted if a faulty product caused the death as can builders.
